Divorce

When any married couple separates there are many issues which must be resolved, including, but not limited to:

  1. Is there any type of pre-marital or post-marital agreement in place regarding property ownership in the case of divorce?
  2. Which property is considered marital property, and which property is considered separate property?
  3. How should the parties divide the marital property, including real estate, retirement accounts, vehicles, savings accounts, checking accounts, time shares, and countless other interests jointly owned by the couple?
  4. Which parties are going to be responsible for which debts owed by the couple?
  5. Should any spousal support be paid from one party to the other? If so, how much is a fair amount? For how long should it be paid?
  6. If there are children of the marriage, then how will custody be divided? What type of visitation agreement will be put in place between the parties? What amount of child support will be paid, if any, and for how long? Who will provide insurance for the child? Who will get to claim the child as a dependent for tax purposes?
  7. Does either party desire a name change once the divorce is finalized?

The list above is simply gives you an idea of the many issues that you may face in divorce proceedings. With years of experience helping clients through this difficult time, we can guide you through the divorce process. We will help protect your interests and make sure that your life is back to a new sense of normalcy as quickly as possible.

Child Custody

The decision on where a child lives is very important to the health and development of any child. Whether a couple has been previously married, divorced, or going through the process of a divorce, having a written agreement between the parties regarding child custody is generally best for everyone involved. A written agreement sets guidelines to which all parties must abide in order to protect the best interests of the child.

With years of experience in child custody matters, we will work hard on your behalf to protect the best interests of your child.

Child Support

Both parents are responsible for the monetary care of their child. However, the amount of child support a non-custodial parent should pay is not always immediately clear. The Kentucky State Legislature has setup guidelines which courts will generally follow in order to determine a fair child support amount. However, there are several factors which can change the obligation owed from the non-custodial parent. Without someone representing you, then the opposing party may have more power in deciding how much child support should be paid. Having calculated support for hundreds of parents, we will guard your interests and make sure that you pay or receive your fair amount of support.
