Title Searches

Before closing on any piece of real estate, it is generally a good idea to perform a title search.  Real property is a major investment, and nearly all mortgage companies will require a title search prior to any property transfer.  If you are planning to purchase a property without financing, it is still a smart idea to invest in a title search for several reasons.

 

A title search will help discover undisclosed liens on the property.  If not paid, then you or your heirs may become liable for that lien after closing.  An undiscovered claim or easement could saddle your property with restrictions or open your property up to third party use.

 

An undiscovered heir or previous illegal deed could have a similar effect.  After your purchase, a previous owner of the property whose interest was never transferred may be able to make a claim against you for ownership the property.
